Board reasoning

The Veteran explicitly withdrew the claims in a July 2026 statement in support of claim, indicating a withdrawal of the appeal on all listed issues. The Board therefore determines there is no remaining allegation of error of fact or law for appellate consideration and dismisses the claims for entitlement to service connection on the basis of withdrawal.

Entitlement to service connection for a left ankle fracture of the tibia and left fibula is dismissed without prejudice. FINDING OF FACT In a July 2026 statement in support of claim, the Veteran expressly requested that the appeal of the denials of his claims of entitlement to service connection for right foot hallux valgus, a speech impediment, deformity of the left lower extremity, left foot hallux valgus, left foot pain, bilateral pes planus, and a left ankle fracture of the tibia and left fibula be withdrawn. CONCLUSION OF LAW The criteria for withdrawal of the appeal of the denials of the Veteran's claims of entitlement to service connection for right foot hallux valgus, a speech impediment, deformity of the left lower extremity, left foot hallux valgus, left foot pain, bilateral pes planus, and a left ankle fracture of the tibia and left fibula have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.205. REASONS AND BASES FOR FINDINGS AND CONCLUSIONS The Veteran served on active duty from October 1982 to January 1983. This matter comes before the Board of Veterans' Appeals (Board) on appeal from a July 2022 rating decision issued by the Department of Veterans Affairs (VA) Regional Office (RO). In December 2022, VA received the Veteran's Form 10182 Notice of Disagreement (Notice of Disagreement). In the Notice of Disagreement, he elected the Hearing Docket. Before the Board held a hearing, the Veteran submitted his statement in support of claim withdrawing the claims on appeal. Dismissal of Claims 1. Entitlement to service connection for right foot hallux valgus 2. Entitlement to service connection for a speech impediment 3. Entitlement to service connection for deformity of the left lower extremity 4. Entitlement to service connection for left foot hallux valgus 5. Entitlement to service connection for left foot pain 6. Entitlement to service connection for bilateral pes planus 7. Entitlement to service connection for a left ankle fracture of the tibia and left fibula The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.205. Withdrawal may be made by the appellant or by his or her authorized representative. Id. Here, in a July 2026 statement in support of claim, the Veteran expressly stated that he sought to withdraw his appeal of the denial of his claims of entitlement to service connection for right foot hallux valgus, a speech impediment, deformity of the left lower extremity, left foot hallux valgus, left foot pain, bilateral pes planus, and a left ankle fracture of the tibia and left fibula. Given the Veteran's expressed desire, the Board concludes that his intent was to withdraw this claim and further action with respect to this claim is not appropriate. Indeed, no allegation of error of fact or law remains for appellate consideration. By virtue of the foregoing, the Board no longer has jurisdiction to review the claims of entitlement to service connection for right foot hallux valgus, a speech impediment, deformity of the left lower extremity, left foot hallux valgus, left foot pain, bilateral pes planus, and a left ankle fracture of the tibia and left fibula and they are dismissed.
